1. General Provisions

THE GARDEN COLLECTIVE d.d. with headquarters in Zagreb, Slavonska avenija 26/1, VAT ID: 54394356292 (hereinafter referred to as TGC) provides an interactive online service through websites on the domain www.thegardencollective.hr. The service consists of providing information services and content management. The term "Website" in these Terms of Use refers to all websites located within the domain www.thegardencollective.hr. For the purposes of these general provisions, the term "TGC company websites" refers to all websites located within the domain www.thegardencollective.hr. These Terms of Use prescribe the terms and conditions relating to the use of the websites by end users. These general terms of use do not apply to the purchase of festival tickets, payment for accommodation directly or indirectly related to music festivals, and the purchase of all products except beer cans, beer bottles, beer in kegs and beer glasses with the printed trademark "The Garden Brewery". These transactions are regulated by separate terms of use.

By using and accessing these websites (except when reading these Terms for the first time), end users declare that they have read and understood the Terms of Use, that they are familiar with them and fully agree with the terms and conditions set forth herein and agree to use the websites in accordance with them.

The right to use the websites is not transferable to other natural or legal persons. The end user is personally responsible for protecting the confidentiality of passwords where they exist as such.

The end user is aware of occasional interruptions, unavailability and/or exclusion of services (routine maintenance, etc.), force majeure events, and TGC is not responsible for any data loss that may occur during the transfer of information on the internet. The end user agrees and accepts that for the stated reasons, access to the websites may be interrupted, temporarily unavailable or excluded.

Information on this website may contain technical inaccuracies or typographical errors. TGC does not represent or warrant, expressly or implicitly, that the content of the website and/or related pages is complete or up-to-date; that the website and/or related pages will always be accessible and available, and that it will not cause damage to users, registered users or third parties. Each user and registered user expressly accepts the use of this website at their own risk and bears exclusively all possible costs related to the maintenance or repair of computer equipment. Any warranty given on these pages relates exclusively to products or services provided by TGC.

TGC reserves the right at any time to change or abolish the website, including, but not limited to, content, availability times, as well as equipment necessary for access or use of the pages. TGC is authorised to cease publishing any part/type of information and to change or abolish any method of data transmission, may change data transmission speeds, as well as any of their other characteristics. Information may be changed without prior notice. TGC may also at any time make improvements and/or changes to the products and/or programmes described in this information, without prior notice. If the User does not accept the Terms of Use, they are obliged to refrain from using them, leave them and not access and/or use TGC's websites.

TGC reserves the right to revise the Terms of Use at any time and to terminate access to the websites without prior notice.

2. Changes to Terms of Use

TGC reserves the right at any time, if it deems necessary, to abolish or change any of the Terms of Use and/or the Privacy Statement set out herein. Any change or abolition of terms and conditions of use will take effect immediately upon publication on the websites. Any use of these websites by the End User after such notice shall be deemed acceptance of those changes.

The User undertakes to periodically re-read the Terms of Use to become familiar with any changes. If the User uses the websites after changes to the Terms of Use, it is presumed that they have become familiar with the changes, understand them and fully accept them. We exclude liability for any damage caused to users, registered users or third parties as a result of such changes.

3. Computer Equipment

The end user is solely and exclusively responsible for the procurement, use and maintenance of their computer equipment, including but not limited to all software and hardware they possess and use, as well as other equipment necessary for access to and use of TGC company websites and all related costs. TGC is not responsible for any damage to the End User's equipment that may arise as a result of using these websites.

4. End User Conduct

These websites, as well as any other pages, now or later contained, or otherwise accessible, through external links to the websites are the private property of TGC.

All mutual interaction that takes place through these websites must be in accordance with the Terms of Use and users are required to ensure that all activities related to the use of these websites are in accordance with the positive legal regulations of the Republic of Croatia.

It is prohibited to publish, use, transmit, send and exchange materials and content that violate or endanger privacy, vulgar, or otherwise undesirable in normal communication, that endanger and/or violate the rights of others, and especially materials and content that are by their nature illegal, threatening, offensive, defamatory, that violate applicable legal regulations of the Republic of Croatia, especially illegal, false or untrue, deceptive, offensive, defamatory, vulgar, obscene, threatening, harassing, racist or chauvinist content, content that violates the intellectual property rights of third parties, content that unauthorisedly discloses personal data or violates the right to personality of third parties or other users as well as other inappropriate content, and content that may cause damage to TGC and related companies, other users or third parties, which includes, among other things, content that encourages behaviour that constitutes a criminal offence, entails civil liability or otherwise violates any regulation and which, without the express, prior, written permission of TGC, contains advertising or offers of any products and services. The end user may not use these websites for advertising or conducting any commercial, religious, political, or non-commercial promotion, including inviting users of these websites to become members of another online or offline service, which represents direct or indirect competition, or potential competition to TGC.

Any behaviour of End Users, which in the discretion of TGC limits or prevents any other end user from using the websites is strictly prohibited.

5. Intellectual Property

These websites contain materials protected by copyright, trademark, design and other information covered by other rights of natural or legal persons, including, but not limited to, texts, software, photographs, video materials, graphics, music, sound, as well as the entire content of the websites, in accordance with the regulations of the Republic of Croatia. All materials (texts, photographs, images, drawings, audio and video materials, etc.) protected product and service marks (trademarks), logos, and other content located on the websites are the exclusive right of TGC, or are used with the express permission of copyright holders and holders of trademark and/or design rights. If not otherwise stated, all other trademarks appearing on the system are the intellectual property of their holders. TGC is the holder of copyright in relation to the selection, coordination, placement and improvement of such content, as well as rights in relation to original content.

Any copying, distribution, transmission, publication, reproduction, modification, revision, transmission, linking, deep linking, creation of derivatives or other modification of these websites without the express written permission of TGC is strictly prohibited.

Any violation of these terms that may result in infringement of copyright, trademark rights, or any other form of intellectual property rights may lead to the initiation of civil, commercial proceedings and/or criminal and/or misdemeanour prosecution against the perpetrator. Copying, redistribution, retransmission, publication or commercial exploitation of downloaded material is not permitted without the express written permission of TGC and the copyright holder.

The end user may download, print and save copyrighted materials only for their own use. The use and printing of content from the websites is permitted exclusively for the purpose of information and personal, non-commercial purposes of the user.

The end user undertakes not to post, publish, or otherwise make available on these websites any material subject to copyright, trademark, or other intellectual property rights, without the express permission of the holders of those rights. The end user is solely and exclusively responsible for damage that may arise from copyright infringement, misuse of trademarks and other intellectual property rights, or any problems arising in connection with the publication of such materials.

TGC has no obligation to inform the End User, or assist them in determining whether certain material is subject to copyright.

By posting material on any publicly accessible part of these websites, the End User warrants under criminal and material liability that they are the holder of rights to that material and expressly grants TGC a free, permanent, irrevocable, non-exclusive right to use, publish, reproduce, reproduce, modify, adapt, distribute, publish, translate and/or distribute such material (in part or in whole) throughout the world indefinitely and permanently. The end user also grants other end users the right to access, view, save or reproduce that material for their own use.

The conditions stated in this Chapter apply equally in favour of TGC, as well as its subsidiaries, related companies and third-party service providers and licensed companies, and each of them has the right to directly and in their own name enforce these conditions.

6. Licenses and Trademarks

By publishing on or through the websites, the End User has granted TGC a free, unlimited spatial and temporal license to use, use, reproduce, change, publish, adapt, translate, distribute, perform and display and communicate, alone or as part of a larger whole, in any form, on any medium or through any technology, whether known or later developed, and to share such rights with multiple license distributors.

By using or accessing this page, the User does not acquire, expressly or implicitly, any license or right to use trademarks, patents, designs, copyrights or other rights belonging to TGC and/or a third party. Users and registered users bear their own responsibility for respecting copyright and other intellectual property rights regarding that content.

7. Warranty Disclaimer and Limitation of Liability

The end user expressly agrees that the use of these websites is solely at the end user's risk. Neither TGC, its subsidiaries, daughter companies, related companies, parent companies, nor any of their employees, agents, third-party service providers or licensed companies warrant that the use of this website will be uninterrupted, or error-free; nor do they warrant (i) the consequences that may arise from the use of this website, or (ii) the accuracy, reliability or content of any information, service or goods provided through these websites.

This disclaimer applies to all damages, direct or indirect, or possible injuries caused by any defects, error, exception, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line interruption, theft, destruction or unauthorised access, changes or misuse of records, breach of contract, inappropriate behaviour, negligence, or any other action. The end user expressly confirms that TGC is not responsible for offensive, inappropriate or unlawful behaviour of other users or third parties and that the risk of damage that may arise as a result of the above lies entirely with the end user.

In no event shall TGC, or any other natural or legal person involved in the creation, production or distribution of these websites, or related content, as well as any software, be liable for any damage that may arise as a result of use, or due to the inability to use these websites. The end user expressly confirms that the terms of this chapter apply to the entire content of these websites.

In addition to the above conditions, neither TGC, nor its subsidiaries, information providers, or content-editing partners, will be liable, regardless of cause or duration, for any errors, inaccuracies, or other deficiencies, inappropriateness or non-originality, of information found on these websites, as well as for any delay or interruption in the transmission of information to the end user, for any claims or losses arising therefrom. None of the above parties will be liable for any claims or losses of third parties, including lost profits.

TGC is not responsible for any content that a user, subscriber, or unauthorised user may post on these websites. Any content that is posted, which is or may be considered inappropriate, may be removed at any time by TGC.

TGC reserves the right to change, adapt, modify, delete or remove any content it deems inappropriate. TGC is in no case liable to anyone for any direct, indirect, special or consequential damage from the use of this or other websites, including, without limitation, loss of profit, business interruption, loss of programmes or other data on your data processing systems or otherwise, even when we have been expressly notified of such damages.

TGC reserves the right to immediately revoke any passwords or End User accounts in the event of any behaviour of the End User that TGC, in its discretion, considers unacceptable, as well as in any case of non-compliance with these Terms by the End User. In the event of revocation of passwords or User accounts, the terms will not cease to apply between the End User and TGC.

8. Monitoring

TGC has the right, but not the obligation, at any time to monitor content on these websites, including any chat rooms and forums that may be contained as part of these websites, to ensure compliance with these Terms of Use, as well as any other rules prescribed by TGC, as well as compliance with any applicable law, regulation or other act. Without limitation of the foregoing, TGC reserves the right to remove any material that, in its own discretion, it finds not to be in compliance with the rules set forth herein, or that it finds otherwise questionable. TGC is not obliged to respond to interactive content.

TGC assumes no responsibility in connection with the accuracy of information it provides and the use of that information is at the recipient's risk. TGC gives no assurance that any reported problems will be resolved using any information that TGC provides. By providing information, TGC does not grant any licenses to any copyrights, patents or any other intellectual property rights.

9. Privacy

The end user confirms that all comments, private messages, forums, chat rooms and/or other methods of sending messages or mutual communication (hereinafter referred to as Communities) are public, not private in nature, and that therefore TGC employees may monitor end user communications without their knowledge and explicit permission.

TGC does not control and/or authorise the content, messages or information that may be found in any Communities and is therefore not responsible for any actions that are the result of end user participation in any Communities, including liability for possible controversial content.

10. Data Confidentiality

TGC does not wish to receive confidential or proprietary information from Users through this website. Any information or material sent to TGC will be treated as non-confidential. By sending any information or materials to TGC, as a User you grant TGC an unlimited and irrevocable license to use, copy, display, perform, modify, transmit and distribute those materials or information, and also agree that TGC may freely use any ideas, concepts, knowledge or techniques for any purpose.

However, TGC will not publish the User's name or otherwise publicise the fact that the User has sent materials or other information, unless: (a) we receive permission from the User to use your name; or (b) with prior notice to the User that materials or other information sent to a certain part of these pages will be published or otherwise used on them together with your name; or (c) we are required to do so by law.

Any type of end user communication is considered non-confidential. If certain websites allow the publication of communications that TGC will treat as confidential, that fact will be stated on those pages.

By posting comments, messages or other information on the websites, the End User grants TGC the right to use those comments, messages or information for the purposes of promotion, advertising, market research, or any other legally permitted purpose. Materials that are sent or available through the websites are not and will not be considered a business secret, secret or confidential. By providing materials through the Website, you authorise TGC and/or its affiliated companies to use them unlimitedly for any purpose, including reproduction, transmission, publication, broadcasting or use in any other way, without the obligation to pay any compensation.

11. Indemnification

The end user agrees to indemnify, and will not hold liable TGC, controlling companies, its subsidiaries, their responsible persons, employees and agents, from all claims for damages and costs, including legal representation costs, which may arise from the use of these websites by the End User.

12. Third Party Content

TGC, as well as Internet Service Providers (ISPs), is a distributor (and not a publisher) of content obtained by third parties and End Users. Any opinions, advice, statements, services, offers, or other information or content posted by third parties, including public information providers, or any end users, come from the respective authors or distributors, not from TGC, nor do third information providers warrant the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose.

Information available on the websites, which represents the opinions and assessments of the relevant information provider, end user, or other user who is not in a contractual relationship with TGC, the same does not authorise and therefore cannot be responsible for the accuracy or reliability of any opinion, advice, or statement published on the websites, by anyone who is not an authorised employee of TGC, or who does not act in an official capacity. Under no circumstances will TGC be liable for any loss or damage caused by the end user's reliance on information obtained through the websites. The end user bears all responsibility to assess the accuracy, completeness or usefulness of any information, opinion, position, advice or other content available through the websites.

TGC's websites contain links to third-party websites maintained by other content providers. These links are posted solely for convenience, and not as an endorsement by TGC of the content on third-party pages, and TGC expressly disclaims any connection with the content or accuracy of materials on third-party websites.

13. Invalid Provisions

In the event of invalidity of individual provisions of the Terms of Use, such invalidity shall not affect the validity of any other provision of these Terms, and the remaining parts of these Terms shall remain in force.

14. Waiver of Rights

If either party does not exercise its rights under these Terms, this shall not be considered a waiver or loss of those rights in the future, nor of any other rights specified in the Terms.

15. Dispute Resolution

For everything not regulated by this Agreement, the provisions of the Law on Obligations apply.

All disputes arising from this Agreement shall be attempted to be resolved amicably by the contracting parties. All disputes or claims that may arise, as a result of the use of these websites, in connection with these Terms, or in connection with their enforcement, are under the jurisdiction of the court in Zagreb, with the application of applicable Croatian substantive law.

16. Application of Terms of Use

These terms of use apply from 27 January 2026 until revocation by TGC.
